These Terms of Service ("Terms") govern your access to and use of the FitClan mobile application ("App"), the FitClan website at fitclan.ca ("Website"), and any related services (collectively, the "Service"), operated by Nishant Mittal ("we", "us", "our").
By downloading, installing, or using the FitClan App, or by accessing the Website, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, do not use FitClan.
You must be at least 13 years old to create a FitFam account. By creating an account, you represent and warrant that you are 13 years of age or older.
Children under 13 may participate in FitFam only as members of a family group where a parent or legal guardian has created the account and is responsible for managing the child's participation. The parent or guardian accepts these Terms on behalf of the child.
The Service is available globally wherever the Google Play Store and (in the future) Apple App Store are available. You are responsible for compliance with local laws in your jurisdiction.
FitClan is a free family fitness gamification application that:
The Service is provided free of charge. We reserve the right to introduce optional premium features in the future, which will be clearly disclosed and will not remove or degrade existing free functionality without reasonable notice.
To use FitClan, you must register an account with a valid email address and a display name. You agree to provide accurate and current information and to update it as necessary.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@fitclan.ca if you suspect any unauthorized access to your account.
Each person may maintain only one FitClan account. Creating multiple accounts to gain competitive advantages on the leaderboard is prohibited and may result in all associated accounts being suspended.
You may delete your account at any time via Settings → Account → Delete Account in the App, or by contacting us. See our Privacy Policy for details on data deletion.
Any registered user may create a family group. The creator becomes the group owner and is responsible for managing membership.
Users join groups via invite codes shared by the group owner. By joining a group, you consent to your display name, points, activity history, and leaderboard position being visible to all members of that group.
As a group owner, you are responsible for:
Your leaderboard data (display name, points, rank) is visible to all members of your family group. This data is not publicly visible outside your group.
You may leave a family group at any time. Your historical points data will be removed from the group leaderboard upon leaving.
You agree to use FitFam only for its intended purpose of family fitness tracking and friendly competition. You agree not to:
FitClan reads fitness data from Android Health Connect solely to calculate points and display activity summaries. You grant FitClan permission to access this data when you authorize Health Connect access on your device.
You can revoke this permission at any time through your Android device settings. Revocation will stop new data from syncing but will not affect your account or previously recorded activity.
You represent that the health and fitness data synced to FitClan belongs to you or to a family member for whom you have obtained appropriate consent (including parental consent for children).
The fitness data, points, goals, and statistics displayed in FitClan are provided for informational and entertainment purposes only. They do not constitute medical advice, diagnosis, or treatment recommendations.
Always consult a qualified healthcare professional before starting any new exercise program, particularly if you have a pre-existing medical condition, disability, or injury. Do not rely on FitClan data to make health or medical decisions.
FitClan assumes no liability for any injury, illness, or health outcome arising from physical activity undertaken in connection with using the app.
The FitClan App, Website, logo, branding, design, code, text, graphics, and all other content are the property of Nishant Mittal and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our express written permission.
You retain ownership of any content you create in FitFam (such as your display name or profile photo). By using the Service, you grant us a limited, non-exclusive license to use, store, and display your content solely to provide the Service to you and your family group members.
If you submit feedback, ideas, or suggestions about FitFam, you grant us an unrestricted, perpetual, royalty-free license to use that feedback for any purpose, including improving the Service. You waive any claim to compensation for such feedback.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Step counts, calorie estimates, and other fitness metrics are estimates provided by Health Connect and the underlying sensors in your device. FitFam is not responsible for inaccuracies in these measurements.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FITCLAN AND ITS DEVELOPER (NISHANT MITTAL) SHALL NOT BE LIABLE FOR:
Our total liability to you for any claims arising from your use of the Service shall not exceed USD $10.00 or the amount you have paid us in the past twelve months, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such cases, the limitations above apply to the maximum extent permitted by law.
You may stop using FitClan and delete your account at any time. Deletion is permanent and cannot be reversed.
We reserve the right to suspend or terminate your account, without prior notice, if we determine that you have:
Upon termination, your right to use the Service immediately ceases. We may, but are not obligated to, provide prior notice before termination. You may appeal a suspension by contacting support@fitclan.ca.
Sections 8 (No Medical Advice), 9 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), and 14 (Governing Law) survive termination of these Terms.
We may update these Terms at any time. When we make material changes, we will:
Your continued use of FitClan after the effective date constitutes acceptance of the revised Terms. If you disagree with the changes, please delete your account before the effective date.
We reserve the right to modify, add, or remove features of the Service at any time. We may introduce optional paid features in the future. We will not remove core free features without reasonable notice.
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at support@fitclan.ca.
If informal resolution is unsuccessful, disputes shall be submitted to binding arbitration on an individual basis, rather than in court. You waive any right to participate in class action lawsuits against FitClan.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
